Permitted Payments & Tenant Protection Information
For properties in England, the Tenant Fees Act 2019 means that in addition to rent, lettings agents can only charge tenants (or anyone acting on the tenant's behalf) the following permitted payments:
Holding Deposit: 1 week’s rent payable to reserve the property. This is refundable if the Tenancy does not proceed but forfeited if the prospective Tenant(s) withdraws for any reason, cannot provide Right-to-Rent information, does not provide required information for referencing or gives false information or fails to sign the tenancy agreement (and/or Deed of Guarantee) within the specified time period.
Deposits: a maximum deposit of 5 weeks' rent for annual rent below £50,000, or 6 weeks' rent for annual rental of £50,000 and above.
Payments to change a tenancy agreement e.g. change of sharer: £50 or, if higher, any reasonable costs.
Lost key(s) or other Security Device will be charged at the actual cost of replacement. If the lost key/security device results in locks needing to be changed, the actual costs of a locksmith, new lock and replacement keys for the tenant, landlord and/or any other persons requiring keys will be charged to the Tenant.
Late/Unpaid rent may be charged at 3% above the Bank of England base rate in interest on the late payment of rent from the date the payment is due but will only be charged once the rent is more than 14 days in arrears.
Early Termination of Tenancy at the Tenant's request (subject to the Landlords agreement): Tenants will be liable for the Landlord's reasonable costs in re-letting the property as well as the rent due under the tenancy until the start date of the replacement tenancy (capped at the landlord's loss and/or the agent's reasonably incurred costs).
